Suspect Flees from Officers…Discards FirearmOn Saturday, April 18, 2009, at approximately 3:53am, officers assigned to Area B-2 (Roxbury), observed an individual, known to them, park his vehicle in the area of Howard Avenue. It was learned that the subject was operating the unregistered motor vehicle with a suspended drivers license. The officers parked their cruiser and approached the suspect on foot while he walked on Howard Avenue.
The suspect immediately took a “bladed stance” while speaking belligerently to officers. He was also observed holding his waistband with his left hand. Fearing the suspect may be in possession of a firearm, the officers attempted to conduct a pat-frisk for their safety. The suspect immediately turned away from the officers and ran towards Dalkeith Street. The suspect continued to hold the left side of his waistband while fleeing.
Officers gave chase and were able to catch up to him a short distance away. The suspect was asked why he ran and he stated, “I have an arrest warrant”. A search of the computer database did not show any warrants for his arrest. Officers then walked the suspects’ route of travel looking for any potentially discarded items. Officers located a .38 caliber Smith & Wesson firearm in a bush in the area the suspect ran by. The suspect stated to officers, “it’s not loaded”. Upon further inspection, it was determined the suspect was correct. The firearm was unloaded. The suspect also informed officers, “I’m not worried about it, my fingerprints aren’t on that gun”.
Officers arrested Levar Fernandes, 27, of Boston on the charges of Unlawful Possession of a Firearm, Resisting Arrest, Operating a Motor Vehicle with a Suspended License, Operating an Unregistered Motor Vehicle and Operating an Uninsured Motor Vehicle.
Officers Seize Loaded Shotgun & Arrest Two
On Saturday, April 18, 2009, at approximately 7:28pm, BPD officers from the Youth Violence Strike Force received information regarding two individuals that were acting suspiciously in the area of Humboldt Avenue. Officers obtained specific information regarding the vehicle (registration & description) that they were operating. It was learned the two exited their vehicle, with hoods up, and appeared to be monitoring a group of youths in close proximity. This general area is considered a high crime area regarding violent crime, including a recent homicide, a stabbing and numerous shots fired calls.
Shortly thereafter, Officers spotted the suspect vehicle traveling on Ruthven Street. Officers began to follow the vehicle when it abruptly pulled to the side of the street and two black males exited. The male suspects appeared to be startled by the officers’ presence and the passenger attempted to reach into the rear of the car. Officers approached and stopped him from doing so. Both parties appeared to be nervous and told inconsistent versions of their activities. A protective sweep of the area the suspect was reaching produced a large capacity Mossberg shotgun (loaded). Officers also located numerous rounds of ammunition.
Officers arrested Daquawn Tyrell Mitchell, 17, of Dedham and a Sixteen-Year-Old (16), black male of Boston on the charges of Carrying a Loaded Shotgun on a Public Way, Illegal Possession of a Firearm and Illegal Possession of Ammunition.
