Answering the call from residents who are fed up with the parties in District 14, at 2:36 this morning officers responded to a radio call for a loud party at 63 Nonatum Road, Brighton. Upon arrival officers could clearly hear loud music coming from the second floor apartment and concluded that it was loud enough to constitute a disturbance of the peace.Napolean Tejera, 23, of Brighton, identified himself as a resident of the apartment. Officers observed approximately 10-15 persons drinking from bottles of beer and engaging in conversation while listening to loud music.
Officers stated to Tejera that the party was over and all guests needed to leave. Tejera was then advised that residents of the apartment were subject to arrest if they refused to stop their disruptive behavior.
Tejera refused to accept the officers request, which caused other guest to loudly protest in favor of suspect Tejera. The officers then advised all persons present that were not residents they need to leave or be subject to arrest as well, and after approx 5 minutes no one would leave. Officers then asked if any other residents were present and suspects Nathan Gustafson, 24, of Brighton and Ryan Mazin, 23, of Brighton, emerged from the crowd and stated they lived there as well.
After more than 5 minutes of offering reasonable explanations for the officers actions and providing suspects sufficient notice they were violating the law, officers provided the residents a final chance to end the party, however they refused again by becoming more boisterous and refusing to ask guests to leave.
Due to the fact that officers provided suspects sufficient opportunity to cease their disruptive behavior and that it became abundantly clear they had no intention of doing so, officers placed suspects Tejera, Mazin and Gustafson under arrest for Disturbing the Peace. They will be arraigned in Brighton District Court on Tuesday.

This report is completely false. I live at this apt. and at no point did any of my roommates object to breaking up the party. The only objection raised was why the police had unlawfully entered the premises and proceeded to search around with flashlights. Following this objection which took place no more than 3 minutes after the police ILLEGALY entered the house, the police instantly placed 3 of my roommates in custody. Then, they proceeded to enter my room where my girlfriend and I were attempting to sleep and threatened to arrest us while searching around the dark room with flashlights. All of our rights were severely trampled that night and this police report is a complete fabrication of the truth.
