WHEN A POLICE OFFICER ASKS YOU TO MOVE .. WHY DO THE OPPOSITE???

About 2:46am, on Thursday, May 20, 2010, officers from Area D-14 (Brighton) were in the midst of a motor vehicle stop at the corner of Chestnut Hill Ave and Sutherland Road when a female walked up to the location of the stop and began creating a disturbance.

Since officers were still in the middle of conducting an investigation and performing a risk assessment of the situation, the female was asked to step away or move back from the scene. Specifically, officers were in the middle of administering a field sobriety test to a motorist who had been operating in an erratic manner. When asked to move back and get back on the curb, the female suspect stated, “No. I’m not going anywhere.\” Officers asked the female to move back a 2^nd time. When asked to move back, the female suspect, undeterred, stated, “No. You’re not doing anything to me.” At this point, a large crowd, somewhat amused by the female’s refusal to comply or acquiesce, began to gather.

At this point, officers informed and warned the female that by choosing to ignore or disregard a lawful command, she could and would be placed under arrest. When the female, again, ignored the lawful instructions, officers placed her under arrest.

 Officers arrested Kathryn Hanley, 29, of Boston and charged her with Disorderly Conduct.
