OBSERVANT OFFICERS NAB ONE FLEEING SHOOTING SCENE

On Sunday, January 24, 2010, at approximately 12:28am, Boston Police Officers assigned out of Area B-3 (Mattapan), responded to Callender Street / Lyford Street for a report of shots fired. The Boston Police Department received an emergency 911 call for gunshots as well as the “Shot Spotter” being activated.

While officers were en-route, they spotted a blue Honda Civic traveling on Callender Street at a high rate of speed. Officers immediately followed behind the suspect vehicle and conducted a stop on Callender Street at Ashton Street.

Once the vehicle came to a stop, the driver’s side – rear passenger, fled from the vehicle. Officers then gave chase on foot down Callender Street towards Lucerne Street. Officers requested additional assistance and continued to call in their location. The suspect jumped fences and cut through yards in an attempt to elude the pursuing officers. One officer noted that the suspect was holding his waistband while he ran. This is a significant characteristic that individuals in possession of a firearm often do. More often than not, individuals illegally in possession of a firearm generally do not utilize a holster and usually place the firearm between their body and the waistband of their pants. This requires the firearm to be held in order to prevent it from falling to the ground and being detected by law enforcement.

Pursuing officers briefly lost sight of the fleeing suspect but were alerted to a “rattling” noise behind 215 Callender Street. Officers continued to search the immediate area for the suspect. Shortly thereafter, an officer located the suspect hiding under a parked vehicle on Floyd Street. The suspect was identified by the officers that initiated the traffic stop and first began chasing him.

A Boston Police K-9 Unit, with ballistic detection certification, was called to the scene of where the motor vehicle was stopped. The K-9 entered the rear, driver’s side door and sat. He then placed his nose to the seat. These actions are consistent with him indicating a presence of gun powder residue. It should be noted that this is the location within the vehicle where the suspect was seated before fleeing.

Officers searched the area of Callender Street for any evidence of a shooting or any potential victims. Officers located Five (5) spent cartridges at the intersection of Callender Street / Lyford Street. No victims were found. A parked vehicle was found to have ballistic damage to it that was parked in the area.

Officers then re-traced the route of travel of the suspect and ultimately searched the yard of 215 Callender Street. This was the location where the “rattling” noise was heard. This noise was believed to be caused by the suspect attempting to jump over a fence. Officers located a black Hi Point 380 calibur firearm as well as three (3) rounds of ammunition.

Officers arrested Daryl Simmons, 22 of Dorchester on the charges of Trespassing, Unlawful Possession of a Firearm and Unlawful Possession of Ammunition.

POLICE BREAK-UP AFTER HOURS PARTY

On Sunday, January 24, 2010, at approximately 12:00am, Boston Police Officers assigned to Area B-3 (Mattapan), were conducting surveillance of 826 Blue Hill Avenue for an ongoing problem regarding after hour parties. Officers also learned that this party was being advertised on MySpace by a male named Elisha Hylton. Partygoers were informed of a party taking place on Saturday, January 23, 2010 at 826 Blue Hill Avenue, apartment #4. It also posted that the admission would be Three-Dollars for the “ladies” and Five-Dollars for the “fellas” and to enter around back.

While conducting surveillance, officers observed numerous individuals arriving at this location. Several people sat in their vehicles for various periods of time before entering the property through the rear entrance of the building.

Officers then decided to speak with the residents of the apartment in order to investigate further. While walking into the building, several individuals quickly ran out the front door in order to avoid the oncoming police presence. The officers immediately heard loud music and numerous people talking.

Officers knocked on the door and were ultimately greeted by a female who identified herself as the lessee of the apartment. She informed the officers she was having a “small birthday party.” Officers also observed an individual playing music with professional DJ equipment.

At this time, a male entered the rear of the apartment and attempted to flee once he observed the officers. He was quickly detained and learned to be the individual advertising the party on MySpace.

Officers located the woman’s three children in one of the rear bedrooms. It was learned that they were 8, 9 & 12 years of age. It should be noted that the furniture throughout the house was moved into one of the bedrooms in order to make room for the party.

The female resident, Calveena Devoe, 38, will be summonsed to Dorchester District Court on the charges of Hosting an Unlicensed / After Hours Party, Keeper of a Disorderly House and Disturbing the Peace. Officers arrested Elisha Hylton (male), 24, on the charges of Hosting an Unlicensed / After Hours Party, Keeper of a Disorderly House and Disturbing the Peace.

THE PARTY IS OVER

On Sunday, January 23, 2010, at approximately 3:08am, Boston Police Officers assigned to Area B-2 (Roxbury), were patrolling the area of Dudley Street when they observed a group of people enter the side door of the Pepper Pot Restaurant – 208 Dudley Street.

The officers knowing the establishment should be closed at this late hour parked their cruiser and walked towards the building in order to investigate.

Upon doing so, the officers observed the restaurant’s windows to be blocked from within by crates and black tarps.

Officers entered the restaurant and observed a party taking place. The officers spoke with an employee of the Pepper Pot Restaurant and he acknowledged hosting an after hours party. The officers also observed alcoholic beverages, beer & liquor bottles, throughout the premise.

The restaurant does not have a license to serve alcoholic beverages and will be cited accordingly.
