At about 3:42pm, on Friday, May 27, 2011, officers from Area A-1 (Downtown) observed and stopped a suspect (wearing a Red Sox shirt) who was wanted in connection with an earlier shoplifting incident. According to the original call, the suspect entered a store in the area of 38 Winter Street, grabbed a Red Sox shirt and fled the store without paying for it. Officers noted that the suspect was wearing what looked to be a brand new Red Sox shirt. Specifically, officers noted that the shirt still had crease lines easily visible.
When asked to return to the store, the suspect agreed. Upon seeing the suspect, the store manager stated,” That’s him and he’s wearing the shirt he stole.”
When officers attempted to take the suspect into custody, a physical struggle ensued. During the course of the altercation, due to the suspect’s refusal comply with the officer’s instructions, officers were forced to employ their department issued OC Spray. After a lengthy struggle, officers were able to handcuff the suspect.
Officers arrested David Fox, 28, of Boston and charged him with Resisting Arrest, Assault & Battery on a Police Officer and Shoplifting.
