Traffic Stop Leads to Gun Recovery

Around 8:50PM on Saturday, June 26, 2010, officers from District B-3 (Mattapan) were on patrol in the area of Blue Hill Ave. and McLellan St. when a random query of car revealed that its owner had a suspended license.

Officers, based on that information, performed a traffic stop to ascertain that the owner was not the driver. Officers, once the car was stopped, approached the car and while doing so observed the front passenger open the door and attempt to exit. Officers gave that front passenger verbal orders to stay in the car until the traffic stop was complete.  Officers then spoke to the driver who they determined did not have a license. While speaking to the occupants of the car, officers detected a strong odor of marijuana and asked if there was any marijuana in the car to which the front passenger handed to officers two medium sized bags of marijuana to officers. Officers, while continuing their conversation with the other passengers of the car, noticed the front passenger make a sudden movement under his seat.

Based on the front passenger’s sudden and alarming movement, and the marijuana that had already been discovered in the car, officers removed all the occupants of the car to make sure that there was nothing that would compromise their safety. Once all the occupants were removed, officers found a loaded handgun underneath the front passenger seat and another medium sized bag of marijuana in the driver’s door.

The driver, Anthony Oliver, 26, of Roxbury was arrested and charged with Operating a Motor vehicle without Being Licensed, and the front passenger, Jerome R. Smith, 22, of Dorchester was arrested and charged with  Unlawful Possession of Firearm, Unlawful Possession of Ammunition, Unlawfully Carrying of a Firearm and Possession of Class D.
